Welcome to Pool Revive LLC ("Pool Revive," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, poolrevive.com (the "Website"), and the pool water draining and deep cleaning services (the "Service") provided by Pool Revive LLC. By booking an appointment, making a payment, or using our Website, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Service.

1. Services

Pool Revive LLC provides a single service: pool water draining and deep cleaning. The Service includes draining the pool and performing a thorough cleaning of the pool interior. Any additional work (e.g., repairs, chemical balancing, or equipment maintenance) is not included unless explicitly agreed upon in writing.

2. Booking and Payment

  • Deposit: A non-refundable $1 deposit is required to reserve an appointment. This deposit confirms your booking and is credited toward the total cost of the Service.

  • Payment Method: When reserving an appointment, you must provide a valid credit card, which will be securely stored in our payment processing system.

  • Balance Payment: The remaining balance for the Service will be automatically charged to the stored credit card immediately upon completion of the Service, unless otherwise agreed in writing.

  • Pricing: Service fees will be communicated at the time of booking. Prices are subject to change, but the quoted price at booking will be honored for your appointment.

  • Failed Payments: If a payment fails, we will attempt to contact you to resolve the issue. You agree to provide an alternative payment method if necessary. Unpaid balances may result in additional fees or legal action.

3. Cancellations and Rescheduling

  • Cancellations: You may cancel your appointment at any time without penalty. To cancel, please email todd@poolrevive.com or call or text 702-718-2727. The $1 deposit is non-refundable.

  • Rescheduling: You may reschedule your appointment at any time without penalty, subject to availability. To reschedule, please email todd@poolrevive.com or call or text 702-718-2727.

  • No-Shows: Failure to be present or provide access to the pool at the scheduled time may result in a fee equal to 100% of the quoted service price.

4. Refunds

If you experience any issues with our Service, we will work diligently to rectify the matter to your satisfaction. However, once the Service has been performed, no refunds will be provided.

5. Service Performance

  • Access: You must provide safe and unobstructed access to the pool and necessary utilities (e.g., water, electricity) for us to perform the Service.

  • Condition of Pool: You agree to disclose any known issues with the pool (e.g., structural damage, leaks, or hazardous conditions) before the Service begins. We reserve the right to refuse or postpone service if the pool is unsafe or unsuitable, and additional fees may apply.

  • Completion: We will perform the Service with reasonable care and skill. Any dissatisfaction must be reported within 24 hours of service completion for review.

  • Unexpected Issues: If unforeseen circumstances (e.g., equipment failure, severe contamination) prevent completion, we will notify you and discuss options, which may include rescheduling or partial refunds.

6. Customer Responsibilities

  • Ensure the pool area is free of hazards (e.g., pets, debris, or unsafe structures).

  • Obtain any necessary permits or permissions for draining water, as required by local laws.

  • Comply with all local regulations regarding water disposal and pool maintenance.

7. Liability

  • Limitation of Liability: Pool Revive LLC is not liable for damage to pools, surrounding property, or landscaping unless caused by our gross negligence or willful misconduct. We are not responsible for pre-existing conditions, normal wear and tear, or issues arising from improper pool maintenance.

  • Indemnity: You agree to indemnify and hold Pool Revive LLC harmless from claims, damages, or liabilities arising from your failure to disclose pool conditions, provide safe access, or comply with these Terms.

  • Force Majeure: We are not liable for delays or failure to perform due to events beyond our control, including weather, natural disasters, or government restrictions.

8. Warranties

The Service is provided "as is" without warranties of any kind, except as required by law. We do not guarantee specific results (e.g., stain removal) due to factors beyond our control, such as pool age or material.

9. Termination

We reserve the right to refuse or terminate service at our discretion, including for non-payment, unsafe conditions, or violation of these Terms. You may terminate your booking subject to the cancellation policy above.

10. Governing Law

These Terms are governed by the laws of [Your State], without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in [Your County].
